It depends from the screen. In mine I clearly see that one is brown, the other one is black.

It depends on eyes, screen, disability, lighting, and probably more.
Just because you can see the difference doesn't invalidate that the colors *are* way to similar.
I had to scoot over so the light hit my screen differently and swap between them to see the difference.
And more importantly, the puzzle gets easier if you split it into too many shades, in this case the picture would look just about identical with just color #4 (black)

A very cute picture, but one with very deceptive colours!
